1. Preamble

1.1 These terms of use (the “Terms of Use”) govern the use of the website of the public benefit foundation under the name “KIND THINGS STICHTING” (the “KIND THINGS Public Benefit Foundation”), which is based in The Hague, the Netherlands, is active, among other places, in Greece, and is accessible at www.kind-things.org (the “Website”). The Website provides users (each a “User”) with information about the programs, initiatives and public benefit activities funded by KIND THINGS Public Benefit Foundation.

1.2 By visiting the Website and by completing and submitting the relevant electronic declaration, the User is deemed to have read, understood and fully accepted these Terms of Use. Accordingly, remaining on the Website and using any information provided on it constitutes unconditional acceptance of the Terms of Use.

2. Use of the Website

2.1 KIND THINGS Public Benefit Foundation permits and encourages private use of any material posted on the Website, including, indicatively, text, photographs, graphics, videos and images (collectively, the “Content”), as well as any functionalities made available through the Website from time to time. The Content may be printed, copied and downloaded solely for informational, research, educational and generally public benefit purposes, provided that KIND THINGS Public Benefit Foundation Website is always cited as the source of the Content, together with the names of the creators where these appear on the Website, and provided further that no industrial or intellectual property rights or applicable personal data protection laws are infringed. Certain files or data may constitute the intellectual property of third parties, such as partner entities or organisations, and may not be used without their permission, therefore they must be obtained separately.

2.2 Use of the Website, or of any part of its Content, for commercial purposes, profit-making purposes or any purpose other than the use described in paragraph 2.1 above is expressly prohibited.

2.3 Access to the Website, browsing of the Website and use of its Content are free of charge. The User is, however, responsible for any costs associated with connecting to the Internet.

3. Amendments – Suspension of Operation

3.1 KIND THINGS Public Benefit Foundation may amend the Terms of Use at any time, always in accordance with applicable law. Any subsequent use of the Website by the User after such amendments will constitute acceptance of the amended Terms of Use.

3.2 KIND THINGS Public Benefit Foundation may modify the Content of the Website, add or remove information and data, and temporarily or permanently suspend the operation of the Website whenever it considers this necessary or appropriate.

3.3 The User will be informed through the relevant pages of the Website of any amendment to the Terms of Use and of any temporary or permanent suspension of the Website’s operation.

4. Disclaimers and Limitations of Liability

4.1 KIND THINGS Public Benefit Foundation makes every reasonable effort to ensure that all Content and information appearing on the Website is accurate, clear, correct, up to date and accessible to users. However, it gives no warranty of any kind and shall not be liable for any damage, including any direct loss or loss of profit, that may be suffered by the User as a result of using the Website, its pages or its Content.

4.2 The Website is not an electronic platform for concluding commercial contracts, but a means of accessing information of an informational, research, educational and generally public benefit nature. Accordingly, KIND THINGS Public Benefit Foundation shall not be liable to the User for any failure, refusal or defective performance of obligations attributed to any natural or legal persons presented on the Website. Nor may the User raise against KIND THINGS Public Benefit Foundation any objections, defences or claims arising from the User’s relationships with such persons solely because they appear on the Website.

4.3 Given the particular nature of the Internet, KIND THINGS Public Benefit Foundation makes its best efforts to ensure that information provided by it or by any third party is posted on the Website in full or in the form in which it was transmitted to KIND THINGS Public Benefit Foundation by such third parties. Such information does not constitute advertising, whether direct or indirect, nor does it constitute a solicitation or advice for the User to perform any act, whether or not such act has financial consequences.

4.4 KIND THINGS Public Benefit Foundation has taken all necessary measures, as required by applicable law and international practice, to ensure a high level of security and protection for its own systems. KIND THINGS Public Benefit Foundation undertakes to upgrade Website’s protection systems and to maintain anti-malware protection programs. However, it cannot guarantee that the Website will operate uninterruptedly or free from errors, viruses, malware, interception incidents or other unauthorised access, and shall not be liable for any damage to User’s equipment, software, files or other property caused by a virus.

5. User’s General Obligations

5.1 The User accepts, agrees and acknowledges that they shall use the Website lawfully and appropriately, in accordance with the Terms of Use and the instructions of KIND THINGS Public Benefit Foundation, as posted from time to time on the Website.

5.2 The User is responsible for ensuring that their computer has the latest updated versions of software, operating systems and anti-malware protection programs installed, as well as any related data and computer protection tools, including antivirus programs, antispyware tools and firewalls.

5.3 The User shall be liable for any direct loss and loss of profit incurred by KIND THINGS Public Benefit Foundation as a result of the User’s acts or omissions, as well as any unlawful, contractual-breaching and/or unfair conduct by the User.

5.4 The User must comply with all obligations provided for by applicable law regarding the protection of Content’s intellectual and industrial property.

6. Hyperlinks

6.1 For User’s convenience only, KIND THINGS Public Benefit Foundation has posted links (hyperlinks) on the Website leading to third-party websites. The content of those websites is created under the exclusive responsibility of the relevant third parties and is not controlled by KIND THINGS Public Benefit Foundation. Accordingly, KIND THINGS Public Benefit Foundation shall not be liable for the content of those websites, as it does not control them and has no relationship with their owners and/or administrators. Nor does it provide any warranty to the User as to the quality or accuracy of the information contained on those websites.

6.2 Linking to the Website from third-party websites is prohibited without KIND THINGS Public Benefit Foundation’s prior written approval.

7. Intellectual and Industrial Property Rights

7.1 Use of the Website and its Content by the User does not create any right in favour of the User over any works, elements or tangible media incorporating intellectual or industrial property rights of KIND THINGS Public Benefit Foundation or of third parties and made accessible through the Website.

7.2 Any use other than that referred to in Article 2 above is strictly prohibited, including, indicatively, any retransmission, publication, adaptation, making available, public presentation, deletion, reproduction, imitation or falsification of the Website and its Content, by any means, in whole or in part, in any form and through any medium. In particular, the User is prohibited from:

a) Extracting or reusing all or a substantial part of the content of the Website database. The User may not perform acts that conflict with the normal use of that database, unreasonably prejudice the legitimate interests of its right holder, or cause damage to copyright owners or related rights in the works contained in the database.

b) Performing any act aimed at decompiling or reverse engineering the source code of the Website software, reconstructing such source code, gaining unauthorised access to any software, system, individual computer, computer network and/or file of KIND THINGS Public Benefit Foundation, or attacking or hacking the Website and its systems in any manner, including, indicatively, through mechanical means or automated methods.

c) Circumventing any technological measures put in place to prevent acts not authorised by KIND THINGS Public Benefit Foundation, where such circumvention is intentionally carried out by the User or where there are reasonable grounds to believe that the User is aware of the effects of their act.

d) Falsifying or imitating the trademark, name or other distinctive signs of KIND THINGS Public Benefit Foundation or of third parties published on the Website. The appearance of a distinctive sign on the Website shall not be construed as a transfer or grant to the User of any licence or right to use that distinctive sign.

e) Removing or modifying the Terms of Use or any other electronic text posted on the Website concerning the protection, use or holder of any industrial or intellectual property right, whether or not the User presents all or part of the Website to the public.

7.3 In the event of any infringement or threatened infringement of industrial or intellectual property rights or related rights, including the sui generis right of the maker of the database, belonging to KIND THINGS Public Benefit Foundation or to third parties, the relevant rights holders may, as applicable, seek the imposition of civil, administrative and criminal sanctions against the person who has infringed or is about to infringe those rights, in accordance with the law.

8. Personal Data Protection

8.1 KIND THINGS Public Benefit Foundation collects only personal data that is strictly necessary for the purpose for which it is intended, and does not further process such data in a manner incompatible with the purpose for which they were collected. As the controller of the personal data it collects through use of the Website, KIND THINGS Public Benefit Foundation undertakes to protect privacy and to provide appropriate safeguards for the protection of such data, in accordance with Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR), Greek law as in force and the applicable regulatory acts of the Hellenic Data Protection Authority.

8.2 KIND THINGS Public Benefit Foundation informs the User that, acting through its officers or external associates, who act on its instructions and on its behalf, it will process personal data sent to it by email or entered on the Website and/or on the Electronic Platform for the Submission of Funding/Financial Support Requests as follows:

a) Type of data: i. In relation to electronic messages (emails): the data entered by the User when sending the electronic message, including, indicatively, email address and full name; ii. In relation to applying for funding by a legal person: full name of the representative of the entity applying for funding, their professional capacity, postal and email address, contact telephone number, and any data entered by the User in free-text fields; and iii. In relation to applying for financial support by a natural person: all data entered by the User in the dedicated application form for the purpose of assessing the request and granting financial support, including, indicatively, full name, father’s name, date of birth, contact telephone number, postal and email address, family and financial status of the applicant and/or their family, registration in public registries, etc.

b) Purpose of processing: i. Assisting the User while browsing the Website; ii. Granting funding, monetary donations and any form of financial and/or material support to natural and legal persons; iii. Presenting and reporting on the public benefit work of KIND THINGS Public Benefit Foundation; and iv. Defending interests of KIND THINGS Public Benefit Foundation and fulfilling its legal obligations.

c) Recipients of the data: For the data necessary to serve each of the above processing purposes, and within the scope of each recipient’s responsibilities, the recipients include: KIND THINGS Public Benefit Foundation, its management team, employees and external associates.

d) Rights of the data subject: Each User may at any time exercise the rights available to data subjects under Regulation (EU) 2016/679, in particular Articles 12 to 23 thereof, including the right to information and access to the data processed by KIND THINGS Public Benefit Foundation, the right to restriction of processing, the right to rectification and erasure, and the right to data portability.

e) Withdrawal of consent: Each User is further informed that they have the right to withdraw their consent to any processing of personal data for which they have given consent to KIND THINGS Public Benefit Foundation.

9. Use of Cookies

KIND THINGS Public Benefit Foundation uses cookies to ensure the optimal and safer use of the Website and of the information communicated. Cookies are small files containing information that a website, specifically its web server, stores on the User’s computer, mobile phone or other electronic device. Each time the User connects to the website, the website retrieves that information and provides the User with services related to it. Cookies do not damage the device or the files stored on it and do not access any document or file on the device of the website visitor. In general, cookies cannot reveal User’s identity, although they may be used to recognise the device. Cookies are divided into various categories depending on their purpose and operation.

The Website uses the following categories of cookies:

• Strictly necessary / functional cookies (essential cookies): These cookies are necessary for the proper operation of the Website and allow the User to use its functions, such as accessing secure areas, maintaining a login session, selecting a language and automatic logout due to inactivity. They cannot be disabled and do not store information that identifies the User for marketing purposes. Some are temporary session cookies, while others are persistent cookies with a maximum duration of seven (7) days.

• Third-party embedded content cookies: Certain pages include audiovisual content embedded from third-party providers, such as YouTube, Spotify and Apple Podcasts. These providers may place their own cookies on the User’s device and act as independent controllers. KIND THINGS Public Benefit Foundation neither influences nor is responsible for the way in which they process data; Users should refer to the respective privacy policies of those providers.

• The Website does not use web analytics cookies, such as Google Analytics, advertising cookies, pixels or user profiling cookies.

10. Applicable Law – Jurisdiction

10.1 These Terms of Use, including any amendments thereto, shall be governed by Greek law.

10.2 KIND THINGS Public Benefit Foundation wishes any disputes arising from the use, interpretation or application of these Terms of Use to be resolved amicably and out of court. In this context, the User may contact KIND THINGS Public Benefit Foundation directly at [email protected]. Failing such resolution, any dispute arising from these Terms of Use shall fall within the exclusive jurisdiction of the Courts of Athens.
